When is it too Late to Fire your Attorney?
Going through a family law dispute can be overwhelming. You hire a family law attorney to help you navigate through the procedure and achieve the most favorable outcome. But what happens if your current attorney is unable to meet your goals or represent your best interests? When is it too late to fire your attorney?
While you have the right to dismiss your attorney at any time, the decision to fire them during an ongoing trial shouldn’t be taken lightly. Having said that, you can seek new counsel if you lose faith in your current attorney’s ability to represent your interests in the best possible way.
There are certain situations when you should avoid firing your attorney, such as -
· If your case is close to a trial date and your attorney has spent significant time preparing for the case.
· If your attorney is amid settlement negotiations or about to reach an agreement with the opposing party.
· If the court believes that a change of attorney would unnecessarily prolong your case, it may deny your request.
The general notion is that if your attorney has prepared and a trial date is near or a settlement is on the cards, switching attorneys could be detrimental to the whole process. Apart from added costs, your new attorney would also require time to prepare for your case.
